Daksh Travel

Terms of Service & Cancellation Policy

1. Scope of Services & Business Model

  1. Daksh Travel is an independent travel service provider based in Agra, Uttar Pradesh, India, providing exclusively licensed tourist guiding services (Incredible India Tourist Guides / ASI approved) and private chauffeur-driven ground transportation services.

  2. Exclusion of Accommodations & Monuments: Daksh Travel does not book, sell, or hold liability for hotel accommodations, guest house lodgings, airfares, or Archaeological Survey of India (ASI) entry tickets. Guests are responsible for purchasing their own monument entry permits and securing their own hotel reservations.

  3. A booking is deemed confirmed only upon receipt of the agreed advance payment and issuance of a written confirmation voucher or confirmation email/WhatsApp from Daksh Travel.

2. Pricing, Inclusions & Payments

  1. Service Inclusions: Quoted rates strictly cover:

    • Professional guiding services for the specified duration and monuments.

    • Private air-conditioned vehicle transfers including vehicle rental, fuel, driver allowances, toll taxes, state border entry permits, and designated parking charges (unless explicitly stated otherwise in the written quote).

  2. Exclusions: Quotes explicitly exclude monument entry tickets, camera/video fees, gratuities/tips, personal shopping, travel insurance, food and beverages, and any unplanned route deviations.

  3. Currency & Taxes: All quotes are provided in Indian Rupees (INR) or agreed foreign currency equivalents. Applicable statutory taxes (such as GST, if applicable) are stated on the final invoice.

  4. Payment Schedule:

    • A minimum advance deposit of 25% to 50% is required at the time of confirmation to secure transport availability and block guide dates.

    • The remaining balance must be settled prior to or upon commencement of the tour on Day 1.

  3. If rescheduling is not possible due to peak season demand, the standard cancellation policy applies.

5. Transport, Luggage & Route Regulations

  1. Safety Compliance: All passengers must wear seat belts in accordance with the Motor Vehicles Act of India. Smoking, consumption of alcohol, or transport of contraband inside the vehicles is strictly prohibited.

  2. Luggage Responsibility: While our drivers take standard precautions, guests are solely responsible for the safety of their cash, jewelry, photographic equipment, passports, and personal belongings. Daksh Travel assumes no liability for forgotten or damaged items inside vehicles.

6. Force Majeure & Limitation of Liability

  1. Unforeseen Events (Force Majeure): Daksh Travel shall not be held liable or responsible for failure to execute tours or delays arising from events beyond reasonable control, including but not limited to: severe weather disruptions (e.g., dense winter fog delaying trains/traffic), VIP monument closures mandated by government/security authorities, natural disasters, strikes, road blockages, or sudden political unrest.

  2. Monument Closures: Guests are reminded that monuments may close for public visits without prior notice on account of state visits or protocol (e.g., the Taj Mahal is closed every Friday). While Daksh Travel will adjust the schedule where possible, no refunds are issued for statutory or sudden state closures.

  3. Third-Party Incidents: Daksh Travel acts as a service provider for transport and guiding. We accept no liability for personal injury, illness, loss, or property damage sustained at monument premises, roads, or dining establishments. Comprehensive travel insurance is strongly advised for all international guests.

7. Code of Conduct & Fair Guiding Assurance

  1. Zero-Pressure Guarantee: In accordance with ethical guiding standards, our guides and drivers will not subject guests to unsolicited commercial sales pitches, emporium stops, or pressure shopping unless an explicit request is made by the guest.
